JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 The petitioner, who claims to be a person of clean antecedents and is in custody since 09.01.2020, seeks bail in connection with G.B. Nagar P.S. Case No. 04 of 2020, dated 04.01.2020, instituted for the offences under Sections 366(A)/34 of the Indian Penal Code.

The mother of the victim girl has lodged the First Information Report that her daughter, who marriage has already been fixed, has been kidnapped by the petitioner and others.

During the course of investigation, the victim girl was recovered and has given her statement under Section

Patna High Court CR. MISC. No.16719 of 2020(2) dt.03-06-2020 2/2 164 of the Code of Criminal Procedure. In the aforesaid statement, she has disclosed her age to be 20 years and categorically stated that she loved the petitioner and when her family members refused consent for marrying him, she ran away with the petitioner. She has expressed her desire to live with the petitioner.

Considering the facts aforestated, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with G.B. Nagar P.S. Case No. 04 of 2020.

The application stands allowed.
