The petitioner is apprehending arrest in a case registered for the offences punishable under Sections of the Indian Penal Code.
It is alleged that during raid one person escaped left with a bag and a country made pistol. On search of the bag, 17 live cartridge, a mobile set, materials used for cleaning the rifle, one knife and one country made pistol loaded with cartridge were found. On query, the name of petitioner sprang up, who flee away from the scene.
It is submitted by learned counsel for the petitioner that the recovery cannot be treated to be from the possession of the petitioner. A statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.20226 of 2015 (2) dt.30-04-2015 2/2 petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bihpur Bhawanipur (Jhandapur) P.S. Case No.377 of 2014, pending before the ACJM, Naugachia, Bhagalpur.
With the above observation, this application is, accordingly, disposed off.
