The petitioner apprehends his arrest in Imamganj P.S. Case No. 130/2015, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is alleged to have assaulted the informant with iron rod on his head. Others are also alleged to have assaulted the informant.

It is submitted that there is a case and counter case. Rinku Khan @ Gurfan Ahmad, the informant got three injuries, but there is no injury on his head. It appears that petitioner is alleged to have firstly fired and then assaulted the informant with iron rod on his head. Of course, no injury was found on his head,

Patna High Court Cr.Misc. No.17207 of 2016 (2) dt.19-05-2016 2/2 but injury on his nose was found and there is hair line fracture at the right hand. Injuries are opined to be grievous in nature. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Imamganj P.S. Case No. 130/2015 pending in the court of learned Chief Judicial Magistrate, Gaya.
