JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners happen to be brothers in law of the deceased and originally, the case was registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code but after investigation, the police submitted charge sheet against some accused persons for the offence punishable under Section 306 of the Indian Penal Code. Moreover, the parents in law of the deceased have already been granted privilege of anticipatory bail by a Bench of this Court.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.19128 of 2015 (3) dt.02-07-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, Judicial Magistrate 1st Class, Patna City, Patna in Fatuha P.S. Case No. 196 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
