The petitioner seeks bail in connection with Banka P.S. Case no. 813 of 2017 registered under Section 30(a) of Bihar Excise Prohibition Act-2016.

6.375 lts. of foreign liquor is said to have been recovered from the Tata Indigo Car and petitioner was apprehended. It is submitted by the learned counsel for the petitioner that the petitioner happens to be commuter of the said vehicle and had no knowledge of hiding liquor in the said vehicle. He has neither any concern with the aforesaid vehicle nor with the seized liquor. No incriminating article has been recovered from his conscious physical possession. Earlier to the case under hand,

Patna High Court Cr.Misc. No.7122 of 2018(2) dt.13-02-2018 2/2 no case under Excise Act has been lodged against the petitioner. The petitioner has been languishing in custody since 02.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-II, Banka in connection with Banka P.S.
