2. The petitioner seeks regular bail in a case registered for the offence under Sections 307, 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, one Pappu Yadav conspired with Md. Chand for killing the deceased Raju Yadav. Raju Yadav provided the shooters and one of the shooter who has been found to be involved in the crime has been identified in the CCTV footage as Dharmendra @ Rohit S/o Md. Zameer.

4. Though the name of the petitioner has come in the F.I.R., but from the materials available on record, it appears that the petitioner is the brother of Pappu Yadav and he may not have been involved in the crime. Petitioner is in jail since

5. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-III, Patna/concerned Court below in connection with Kadam Kuan P.S. Case No. 455 of 2023 subject to condition that:- 7(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
