JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.12.2017, seeks bail in Kadamkuan PS Case No. 599 of 2017 registered under Sections 20/22 of the NDPS Act.
The allegation in brief is that the police apprehended three persons moving in suspicious condition and recovered 2.1 Kilogram Ganja from the possession of Golu Kumar and Rs. 15,500/- cash and one Samsung mobile from the possession of the petitioner. Learned Counsel for the petitioner submits that there is no recovery of any contraband from the possession of the petitioner, the cash and mobile are personal belongings of the petitioner and he has got fair antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Neeraj Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge, Patna in connection with Kadamkuan PS Case No. 599 of 2017.
