No.22573 of 2014(10) dt.07-02-2018 2/2 even otherwise the petitioner is stated to have nothing to do with the alleged occurrence since he stays at Gurgaon, I deem it fit and proper to set aside the order taking cognizance dated 06.12.2012 passed in Complaint Case No. 3401 of 2011 (Trial No. 3497 of 2014), whereby and whereunder the learned Judicial Magistrate, 1st Class, Chapra has taken cognizance, insofar as the same pertains to the petitioner herein. The petition is allowed as far as the petitioner herein is concerned.
