JUSTICE BIRENDRA KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with S.T. No. 452 of 2017 arising out of Town P.S. Case No. 135 of 2017, a case under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

According to the F.I.R., allegation is against four persons including the petitioner and co-accused Avinash Kumar to have trespassed into the shop of the brother of the informant and caused fire arm injury resulting into death of the brother of the informant. Patna High Court Cr.Misc. No.11066 of 2018 (2) dt.27-02-2018 2/2 operate with the trial. The allegation is general and omnibus. Petitioner has got no criminal antecedent and he is in custody since 17.03.2017. Co-accused Avinash Kumar has already been allowed bail in Criminal Miscellaneous No. 37142 of 2017 by a co-ordinate Bench of this Court.

Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No. 452 of 2017 arising out of Town P.S. Case No. 135 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
