JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Niranjan Parihar, learned counsel for the petitioner and Sri Shyam Kumar Singh , learned A.P.P. The sole petitioner, who is in custody since 24.04.2017 in N.D.P.S. Case No. 03 of 2017 [ arising out of Jhajha P.S. Case No. 106 of 2017 ] registered for the offence under Section 272, 273 of the Indian Penal Code, 1860 , section 30 and 41 of the Bihar Prohibition And Excise Act 2016 and Section 20 of the Narcotic Drugs And Psychotropic Substances Act, 1985 has prayed for grant of bail .
It was submitted by learned counsel for the petitioner that recovery of about 4.5 liters of Indian make foreign liquor as well as one kilogram Ganja was shown from a railway quarter and petitioner was made accused in the present case. He submits that recovery of Ganja was in small quantity and though
Patna High Court Cr.Misc. No.42801 of 2017(2) dt.19-09-2017 2/2 petitioner was not having any connection with the said recovery he has been made accused . Learned counsel for the petitioner has drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent , period of custody as well as quantity of the recovered Ganja, let the petitioner Jay Singh Banra be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned ADJ Ist Jamui/ concerned court in connection with NDPS Case No. 03 of 2017 [arising out of Jhajha P.S. Case No. 106 of 2017].
