JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-07-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of direction/directions, order/orders and commanding the respondents in the appropriate nature of writ for vacating the Thakurbari land pertaining to Khata No. 87, Plot No. 18, 24, 26, 60, 90, 234, 289 and 293 under Zamabandi No. 87, measuring Area 10 Acres 34

Patna High Court CWJC No.4159 of 2024(2) dt.11-07-2024 2/2 decimals situated at Mauza Balan, Thana No.86 which has been encroached by the Respondent No.7, 8 and 9 by way of using as agriculture/cultivation purpose without consent of Mahant keeping under threatening.

(ii). For direction to Respondent No.3 to declare the petitioner as Mahant being the Chela and successor of earlier Mahant Late Dipu Das of Thakurji Maharaj Sita Ram Chandra Thakurbari." 2.

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondent No. 6 i.e. the Circle Officer, Sadar, Madhepura, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
