This is an application for bail in connection with Jale P.S.Case No. 211 of 2016 registered for the offences punishable under Sections 302, 201, 364 and 120B of the Indian Penal Code. Allegation against the petitioner is that he has taken the deceased on the assurance of providing him a motorcycle and deceased had gone along with Rs.50,000/- with him and thereafter the deceased was traceless.

Submission of learned counsel for the petitioner is that he has been implicated in this case on the basis of suspicion and except that there is nothing against him and co-accused persons have been granted bail by orders contained in Annexures 2 & 3. Further submission is that petitioner is in custody since 8.12.2016.

Patna High Court Cr.Misc. No.42881 of 2017 (2) dt.18-09-2017 2/2 Heard learned APP also, who has opposed the prayer for bail stating that petitioner has taken the deceased with him and deceased was carrying Rs.50,000/- and thereafter he did not return.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it as early as possible, preferably within a period of one year.
