Renuka Ratnakar ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the record and heard learned counsel for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Awtarnagar P.S. Case No. 19 of 2020, registered for offence punishable under sections 188, 272, 273 and 308 of the Indian Penal Code and under section 30/ 30 (A)/38 of the Bihar Prohibition and Excise Act. On the basis of secret information, the police conducted a raid and recovered 60 litres of mahua wine and the petitioner has been arrested at the spot.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.01.2020.

Considering the period of custody, the petitioner,

Patna High Court CR. MISC. No.12603 of 2020(2) dt.13-05-2020 2/2 named above, is directed to be released on bail on his personal bond to the satisfaction of 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran in connection with Awtarnagar P.S. Case No. 19 of 2020, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
