JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 After some arguments, Mr. Ranjay Kumar Singh, learned Advocate for the petitioner seeks permission to withdraw this application in order to surrender before the court below and seek bail.

Should he so surrender, the court below shall take into account whole facts including that the informant now does not wish to prosecute the petitioner any further and the only nonbailable Section in this case is Section 379 IPC, which is not made out, and shall pass orders in accordance with law without being prejudiced by the fact that the present petition on his behalf has not been entertained.

The petition stands dismissed as withdrawn.
