The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 324, 307, 504 of the Indian Penal Code.
When the informant was returning his home, on the way the petitioner obstructed him and gave razor blow on his neck.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to land dispute. He submits that charge-sheet has already been submitted and there is allegation of tampering with the prosecution witnesses by the petitioner. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody
Patna High Court CR. MISC. No.26020 of 2021(3) dt.28-10-2021 2/2 since 19.10.2020.
However, learned APP for the State opposes the prayer for bail and submits that injuries found on the informant is grievous in nature.
Considering the facts and circumstances of the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shambhuganj P.S. Case No. 145 of 2013.
