ANJANA MISHRA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498-A and other Sections of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that at all material times petitioner is willing and ready to keep the opposite party no. 2 with full honour and dignity. However, she left her matrimonial home with her father yet he is willing to keep the informant with full dignity and honour.
Patna High Court Cr.Misc. No.19236 of 2015 (3) dt.22-09-2015 P2/2 Learned counsel appearing on behalf of the opposite party no. 2 submits that she is willing to stay with her husband (petitioner) on the assurance that she will not be subjected to any mental torture in future or will not be prejudiced in any manner. It is however, made clear that the present order is being passed on account of bonafide offer made by the petitioner and if at all there is any untoward act of mental torture to her, it shall be open to her to seek appropriate relief for modification of the order.
Considering the aforementioned facts and also the bonafide offer made by the petitioner, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamui in connection with Jamui Mahila P.S. Case No. 01/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
