The petitioner, who is in custody, seeks bail in connection with Sikandra P.S. Case No. 94 of 2017 registered for the offence punishable under Sections 414, 467, 468, 471, 484, 34 of the Indian Penal Code.
The allegation against the petitioner is of preparation of forged document of ownership of motorcycle. Learned counsel for the petitioner submitted that the name of the petitioner transpired in this case on the basis of statement made by Praveen Kumar and Mithilesh Choudhary. On the basis of statement made by said two persons raid was conducted at the workshop of petitioner and three motorcycle were
Patna High Court Cr.Misc. No.48469 of 2017 (3) dt.12-12-2017 2/2 recovered, out of these motorcycles one motorcycle is of father of the petitioner and other two belongs to customers who had kept there for servicing and repair. It has been further submitted that similarly situated co-accused persons namely Praveen Kumar and Mithilesh Choudhary have already been granted bail by this Hon'ble Court passed in Cr. Misc. Nos. 48232 of 2017 dated 28.11.2017 and 48866 of 2017 dated 17.10.2017 respectively. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 07.07.2015. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui, in connection with Sikandra P.S. Case No. 94 of 2017.
