JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bachhwara P.S.Case No. 96 of 2007 registered under Sections 406, 409, 419, 420, 467 and 471 of the Indian penal Code.
Allegation in brief is that the then Chairman of the PACS named in the FIR as an accused collected loan amount of Rs. 46,64,302/- approximately from the farmers but he deposited only 30,14, 867 and odd with the bank and thus defaulcated Rs. 16 lacs and odd money.
Submission is that only specific allegation in the FIR is against the Ex-chairman of the PACS and the petitioner has only been implicated because of being driver of Ramakant Rai at the
Patna High Court Cr.Misc. No.7959 of 2018 (2) dt.09-02-2018 2/2 relevant time and he has clean antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Binod Choudhary @ Binod Kumar Choudhary is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-6th, Begusarai in connection with Bachhwara P.S. Case No. 96 of 2007.
