Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Excise PS case no. 1649 of 2024 dated 14.09.2024, disclosing offences punishable under Sections 30(a), 32(3) of Bihar Prohibition and Excise Act, 2016. 3.

The prosecution story, as per the First Information report, is that on 13.09.2024, police got secret information that huge consignment of illicit foreign liquor was being unloaded by petitioner along with other accused persons and kept at Mahila Mandal Bhawan at village-Fanda. Patna High Court CR. MISC. No.14179 of 2025(2) dt.27-02-2025 2/3 saw 10 persons fleeing from the place of occurrence. On search, 1172.460 liters of illicit foreign liquor was recovered. 4.

Learned Counsel for the petitioner submits that the petitioner is not having any criminal antecedent and he has been made accused on the basis of secret information and due to village politics. He further submits that the liquor has been recovered from Mahila Mandal Bhawan, which is a public place, accessible to all. He also submits that the liquor has not been recovered from the conscious possession of the petitioner and/ or premises belonging to him. 5.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that illicit liquor has been recovered from public place and petitioner is having no criminal antecedent as also the fact that similarly situated co-accused has been granted anticipatory bail by this Court vide order dated 12.12.2024, passed in Cr. Misc. No. 81721 of 2024, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-
