The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.
It is alleged that four miscreants entered into the rice mill of the informant and committed theft. Out of them two were apprehended, who disclosed the name of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent, statement to that effect has been made in para 3 of the petition
Patna High Court Cr.Misc. No.20506 of 2015 (02) dt.05-05-2015 2/2 and only on confession of the co-accused the petitioner has been roped in the present case.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sadar P.S. Case No. 366 of 2014 pending in the court of learned Chief Judicial Magistrate, Purnea.
With the aforesaid observation, this application is disposed of.
