Petitioner is languishing in judicial custody since 29.05.2017 in connection with Sono P.S. Case No. 86 of 2016 for offences punishable under Sections 406, 420/34 of the Indian Penal Code.
The prosecution case, as lodged by the Commissioner, State Information Commission, is that one Jarina Khatoon who was the chairman of Mahila help line along with the petitioner and Branch Manager of Bihar Regional Rural Bank Khapadia have misappropriated Rs. 1, 09,000/- from the account. Patna High Court Cr.Misc. No.34364 of 2017 (3) dt.30-08-2017 2/3 granted privilege of bail by the learned court below itself and the alleged chairman Jarina Khatoon has also been granted privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 31605 of 2017 on 13.07.2017. He submits that he has no concern with the said N.G.O Mahila help line as he has another N.G.O. Mahila Gram Kalyan Evam Vikas Samiti and the allegations are false. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st Jamui in connection with Sono P.S. Case No. 86 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner would be local person having immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the

No.34364 of 2017 (3) dt.30-08-2017 3/3 disposal of trial and make himself available as and when required by the court and on the event of failure on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail bonds.
