The petitioner is in custody in connection with Bandhuwa Kurawa P.S. Case No. 62 of 2017, a case under Sections 25(1-b)a/26 of the Arms Act.
A loaded country-made pistol was allegedly recovered from the possession of the petitioner. Petitioner is in custody since 23.10.2017.
Submission of the learned counsel for the petitioner is that petitioner has got no criminal antecedent and a bare perusal of the seizure-list would reveal that it was prepared much before the institution of the F.I.R. and it is surprising that P.S. Case number was mentioned in the seizure list. Moreover, it
Patna High Court Cr.Misc. No.6670 of 2018 (2) dt.05-02-2018 P2/ was not signed by the petitioner.
Considering the nature of allegation against the petitioner, let the petitioner, above named, be released on bail on completion of nine months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
