2. The petitioner seeks regular bail in connection with Fatuha P.S. Case No. 56 of 2016, S.T. No. 148 (A)/2017 registered for the offence under Sections 302, 307, 427, 120(B) of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is accused of having participated in the killing of the deceased one Brijnathi Singh who was killed by A.K. 47 Rifle in a broad day light.

4. The petitioner is an absconder and his trial was separated from that of other co-accused out of which three have been convicted and three have been acquitted.

5. Considering the fact that the petitioner is an absconder and he has not allowed the trial to proceed, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The trial Judge is directed to proceed in the case on day to day basis and conclude the trial of the petitioner at the earliest.

8. Let a copy of this order be communicated to the Principal District and Sessions Judge, Patna through FAX for its compliance.
