JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.12.2017, seeks bail in Bachhwara PS Case No. 35 of 2017 registered under Sections 147, 148, 149, 307, 379, 506, 326 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that the accused persons were filling a drainage so the informant objected, then petitioner shot at him which hit his right thigh, one Manoj Kumar another accused also shot from the country made pistol causing fire arm injury in the leg of cousin of the informant.

Learned Counsel for the petitioner submits that the injuries are superficial in nature.

Whereas learned Counsel for the State submits that corresponding fire arm injury was found on the person of the informant and there is specific allegation of opening firing by this petitioner.

Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months and if not concluded the petitioner may renew his prayer for bail.
