Petitioner is apprehending his arrest in connection with Special Case no. 4 of 2014 arising out of Sadar Saharsa P. S. Case no. 194 of 2014 registered under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act. Earlier also the petitioner had moved this Court for grant of anticipatory bail which was dismissed as withdrawn vide order dated 20.8.2014 passed in Cr. Misc. no. 24795 of 2014. In the said order it has been recorded that petitioner was permitted to withdraw the application with liberty to surrender before the court below within a fortnight with the prayer for regular bail which would be considered on its own merit.

Considering the fact that petitioner had already moved before this Court and had preferred to surrender before the court below and on earlier occasion his prayer was rejected after considering the documents, the present application for anticipatory
