2. The petitioner seeks bail in connection with Byepass P.S. Case No. 390 of 2023 dated 17.08.2023, instituted for the offence punishable under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code.

3. The prosecution case in short, is that, there is a public toilet in the village which was used by the villagers jointly but the co-villagers namely, Bablu Kumar Singh, Sunil Singh (petitioner) and Haricharan Singh restrained the informant for using the public toilet and started abusing and assaulting him. It is further alleged that Sunil Singh (petitioner) threw bricks on the face of the informant causing injury. Bablu Kumar Singh snatched gold pendant and assaulted the wife of

Patna High Court CR. MISC. No.15070 of 2025(2) dt.19-03-2025 2/3 informant. It is further alleged that Bablu Kumar Singh and Sunil Singh (petitioner) snatched Mangalsutra and Jitiya from the wife of informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that as per the injury report, the injury is found to be grievous in nature. It is also submitted that the occurrence took place due to petty dispute. It is next stated that similarly situated co-accused namely, Bablu Kumar Singh and Hari Charan Singh have been granted bail vide order dated 10.01.2025 and 24.07.2024 passed by this Court in Criminal Miscellaneous No. 87481 of 2024 & 44759 of 2024 respectively. Lastly, it has been submitted that the petitioner is in custody since 28.10.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Patna City,
