====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-01-2021 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Phulwariya P.S. Case No.118 of 2019 registered under Sections 342, 325, 326, 307, and 504/34 of the Indian Penal Code. The accusation is that on 27.06.2019 at about 12.30 P.M., the informant had gone to Phulwariya Block for correction in the Aadhar Card. At that time, both the petitioners along with Banti Kumar and Akash Kumar along with five unknown came near the informant and started to cause assault to the informant through lathi and danda. When the informant asked them the reason about causing assault to him, then the petitioner no.1
Patna High Court CR. MISC. No.12924 of 2020(6) dt.08-01-2021 2/2 Ujjawal Kumar abused the informant and caused assault to him through Daab. In the meantime, the local persons of the block came there and saved the informant.
Learned counsel for the petitioners submits that the informant and the petitioners are students and they were known to each other. Due to some dispute, the informant has lodged the present case. Moreover, the two injuries, which are said to have been found on the person of the informant, as detailed in paragraph-19 of the case diary, are simple in nature. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIII, Gopalganj, in connection with Phulwariya P.S. Case No.118 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
