2. Petitioners apprehend their arrest in a case registered for the offence punishable under section 126 ( 2 ), 115 ( 2 ),

Patna High Court CR. MISC. No.16997 of 2025(2) dt.22-04-2025 2/3 109, 74, 352, 303 ( 2 ), 329 (3) , 351 (3) , 351 ( 2 ), 3 (5) of the BNSS.

As per F.I.R., informant namely Seema Devi alleged that on 10.11.2024 at 4 PM while she was at her home , in the meantime , all the F.I.R., named accused persons along with 10 to 12 unknown persons came there and started abusing informant and asked about her son Gaurav Kumar. It is further alleged that all the accused persons assaulted her family members by means of deadly weapons, causing severe injuries to them. Petitioner No. 1 and 9 assaulted husband and son of informant.

4. It is submitted on behalf of the petitioners that dispute arose between both the parties on account of immersion of Goddess Saraswati Mata . Present case is counter blast of Bakhtiyarpur P S Case No. 645 of 2024 which was lodged by wife of petitioner No. 1 against informant side and in retaliation this false and concocted case has been lodged. Allegation is general and omnibus against these petitioners. It is further submitted that as per F.I.R., all the accused persons assaulted informant and her son and husband but doctor has not found any external injury on the body of son and husband of informant that itself falsifies the entire prosecution case . 5 . Learned counsel for the State oppose the bail petition .

6 Considering the fact that allegation is general and omnibus against these petitioners, clean antecedent and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Iii Barh in connection with Bakhtiyarpur P.S. Case No. 646 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
