The petitioner apprehends his arrest in a case registered for the offence under Sections 436, 307, 302/34 of the Indian Penal Code.
As per F.I.R., this petitioner alongwith other coaccused persons burnt the house of the informant in which two persons died and several sustained burn injury. It is submitted on behalf of petitioner that specific accusation is against co-accused Md. Mokhtar and petitioner, who happens to be Bhagina of co-accused Md. Mokhtar, has been falsely implicated in this case out of old grudge and enmity. As per F.I.R., this petitioner was present at the place of occurrence with co-accused Md. Mokhtar, but there is no allegation that he played any role. There is no specific accusation of overt act against this petitioner. Petitioner has got clean antecedent.
