I. A. No. 3331 of 2015 has been filed by the District Programme Officer (Establishment), Motihari, East Champaran for waiver of the cost imposed upon him under the circumstances indicated in the Interlocutory Application.

Though the Court is not satisfied as such with the reasons indicated therein for waiving the cost, but on a clear undertaking, having been given by the said Officer that there shall not be any delay in providing inputs and filing affidavits with regard to cases relating to his office in future, the Court modifies or recalls the Order, imposing cost upon him.

Patna High Court CWJC No.2458 of 2015 dt.21-04-2015 2/2 Interlocutory Application stands allowed, accordingly.

Personal presence of the District Programme Officer (Establishment), East Champaran, Motihari stands dispensed with.

Counsel for the State informs the Court that vide letter no. 603, dated 20th of September, 2013, the District Magistrate has transferred the appeal of the petitioner, filed before him, before the competent appellate authority, who is supposed to be the Deputy Director, Welfare, Tirhut Division. Since it is an old matter, which requires some kind of earlier adjudication, let the petitioner file a copy of the Order passed today before the Deputy Director, Welfare for hearing and decide the matter on merits, preferably within a period of three months from the date of production / communication of a copy of this Order.

Writ application stands disposed off in terms of the above.
