The petitioner apprehends his arrest in Baikunthpur P.S. Case No.222 of 2018 registered under Sections 420, 379/34 of the Indian Penal Code and under Section 30(a), 41(i)(ii) of Bihar Prohibition and Excise Act.

The police on secret information went near water tower in village Shankarpur and found a truck parking there. Seeing the police many persons started fleeing away but one person namely Ramesh Singh was apprehended. Ramesh Singh disclosed the name of other accused persons. From the seizure list, it appears that huge quantity of Indian made foreign liquor

The learned counsel for the petitioner submits that the name of the petitioner was also disclosed by Ramesh Singh who was apprehended on the spot but nothing has been recovered from the possession of the petitioner. Similarly situated other accused persons namely, Sanjay Singh, Mithilesh Singh, Sunil Singh, Pappu Singh and others have been granted anticipatory bail by different Benches of this Court. The case of the petitioner stands on the same footing. Petitioner has got no criminal antecedent.

Taking into consideration the fact that name of the petitioner was disclosed by Ramesh Singh, the person who was arrested on the spot, but nothing has been recovered from the possession of the petitioner and similarly situated other accused persons whose names were also disclosed by Ramesh Singh have already been granted anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj in
