JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Barh P.S. Case No.03 of 2020 registered under Sections 341, 342, 323, 326, 307, 386 and 387/34 of the Indian Penal Code. The accusation is that in between 09.00-09.30 A.M. on 03.01.2020, the informant Dayanand Prasad was at his shop. At that time, two unknown persons came there and demanded ransom of Rs.1,00,000/- from him. When the informant made protest, then they folded his mouth with cloth and also tied his both legs. Thereafter, they started to cause assault to the informant through knife, due to which the informant became injured. They also started to snatch the key of the cash box of the informant but the informant tried to raise alarm. In the meantime, another customer came at the shop of the
Patna High Court CR. MISC. No.13042 of 2020(3) dt.16-06-2020 2/2 informant and started to raise alarm on which local people came there and apprehended both the persons and handed over them to the police.
Learned counsel appearing on behalf of the petitioner submits that while it is alleged in the F.I.R. that two persons were apprehended by the local people and handed over to the police but the name of those persons have not been disclosed in the F.I.R.. Later on, the petitioner and one Nitish Kumar was apprehended by the police on mere suspicion and, thereafter, the police got recorded the confessional statement of Nitish Kumar, showing his involvement and the involvement of the petitioner in the present case, which would appear from paragraph-11 of the case diary. The petitioner has no criminal antecedent and is in custody since 04.01.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Barh, Patna, in connection with Barh P.S. Case No.03 of 2020.
