This is an application for bail in connection with Begusarai Town (Nagar) P.S. Case No. 168 of 2017 registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act.
Petitioner is named in the FIR and allegation against the petitioner and other co-accused persons is of firing on the deceased.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he happens to be brother of co-accused, who has land dispute with the informant and he is in custody since 5.4.2017.
Heard learned APP and learned counsel for the
Patna High Court Cr.Misc. No.40295 of 2017 (3) dt.20-09-2017 2/2 informant. They have opposed the prayer for bail stating that there is specific allegation against the petitioner and there were seven wounds of entry found on the person of deceased. Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned court below is directed to expedite process of commitment of the case and once case has been committed, learned trial court is directed to expedite the trial and try to conclude it within nine months.
