The petitioners apprehend their arrest in a case under Sections 141, 447, 323, 337, 307, 504/34 of the Indian Penal Code.
Allegation against the petitioners is that petitioner no. 1 Laddu Lal Tanti assaulted Surendra Tanti, son of the informant, with iron rod on his head and petitioner no. 2 Maltan Tanti assaulted the son of the informant with lathi on his head. It is submitted that the injury report (Annexure 2) shows that both the injuries are simple in nature. There is land dispute between the parties. Co-accused Ram Pravesh Tanti and others have already been granted anticipatory bail vide order dated 15.12.2015 passed in Cr. Misc. No. 56711/2015.
Patna High Court Cr.Misc. No.14127 of 2016 (3) dt.20-04-2016 2/2 Considering the facts aforesaid, the above named petitioner, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Khagaria (Muffasil) P.S. Case No. 676/2015, G.R. No. 2524/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
