The petitioner seeks bail in a case registered for offences punishable under sections 273 of the Indian Penal Code and 30, 30 (a) and 30 (d) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 174 litres country-made liquor and 480 litres semi prepared country-made liquors were recovered from the forest. It is alleged that the petitioner has been implicated on the basis of the statement made by one apprehended person. Petitioner claims that he is having clean antecedent and is in custody since 21.12.2016. Having regard to the facts and circumstances of the

No.34986 of 2017(2) dt.10-08-2017 2/2 case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Bagaha, West Champaran in connection with Valmikinagar P.S. Case No. 91 of 2016 with condition that one of the bailors of the petitioner shall be the resident of the State of Bihar.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
