Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364A/34 of the Indian Penal Code.

It is alleged that the son of the informant was kidnapped on 29.08.2006. The petitioner is not named in the First Information Report but his name sprang up during investigation.

It is submitted by the learned counsel for the petitioner that co-accused Khalim Miya has been acquitted vide Sessions Trial No. 273 of 2009 and other accused Rahees Mian @ Rahees has been granted bail vide Cr. Misc. No. 23980 of 2014. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.19358 of 2015 (2) dt.29-04-2015 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khaira P.S. Case No. 135 of 2006, pending in the court of learned Judicial Magistrate, Ist Class, Jamui. With this observation this application is disposed of.
