JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-08-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier twice rejected by orders dated 08.03.2016 and 18.01.2017 passed in Cr. Misc. Nos. 54118 of 2015 and 51720 of 2016, on the ground that the petitioner is suffering in custody since 23.02.2015 having no criminal antecedent, there is no eye witness of the occurrence and only on the suspicion the petitioner has been named.

The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the deceased before his death has stated that the petitioner has assaulted him by providing drink and further the petitioner had taken away the deceased.

No.39414 of 2017 (2) dt.30-08-2017 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with S.T. No. 348 of 2015/ 72 of 2015 arising out of Amba P.S. Case No. 15 of 2015 pending in the court of 1st Additional District & Sessions Judge, Aurangabad.

However, considering detention of the petitioner, the learned trial court is again directed to expedite the trial and to conclude the same as early as possible preferably within three months from the date of receipt/production of a copy of this order. (Jitendra Mohan Sharma, J) Abhay/- U T
