The petitioner, who is in custody, seeks bail in connection with Industrial Area P.S. Case No. 158 of 2017 registered for the offence punishable under Sections 467, 468, 469, 470, 471, 420, 120(B)/34 of the Indian Penal Code. Informant is the S.I., in his written complaint has stated that on 14.10.2017 when he was on patrolling, as soon as he reached near Anamika Hotel where he found two suspected persons talking to each other. On enquiry they disclosed their name Atul Shukla and Anupmani Tripathi and they are engaged in passing the candidates in Bihar Constable Employment Examination and U.P. Teacher Selection Examination 2017. They

Patna High Court Cr.Misc. No.6906 of 2018(3) dt.28-02-2018 2/3 disclosed the details of their and admitted that they take Rs. 6 lacs from each candidates. It has further been stated that the police went to Hazaribagh and arrested one Pawan Kumar Rai and Chandan Kumar from Anamika Hotel.

Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. It has further been submitted that petitioner is running a small books stall and forms etc. and he also used to take small amount for depositing the forms of the candidates who used to apply for the different posts. It has further been submitted that coaccused, namely, Atul Shukla, has already been granted bail by a co-ordinate Bench of this Court by order dated 27.02.2018 passed in Cr. Misc. No. 7491 of 2018. It has further been submitted that petitioner has clean antecedent and he is in custody since 17.10.2017 and charge sheet has been submitted on 08.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection
