The petitioner seeks bail in Sessions Trial No. 38 of 2015, arising out of Begusarai Muffasil (Singhaul O.P.) P.S. Case No. 213 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

There is specific allegation against the petitioner that the petitioner and other accused persons indiscriminately made firing causing death of son of the informant on the spot. Many firearm injuries were found on different parts of the body of the deceased. Prayer for bail of the petitioner was earlier rejected vide order dated 13.08.2015 passed in Cr. Misc. No. 30523 of 2015 and

Patna High Court Cr.Misc. No.35209 of 2017 (2) dt.06-09-2017 order dated 14.12.2016 passed in Cr. Misc. No. 41277 of 2016. It appears that all the prosecution witnesses have already been examined and the trial is at its fag end.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
