Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown.

Submission is that nothing stolen was recovered from possession of the petitioner nor he was ever put on TI Parade. Only material is the confessional statement of co-accused and criminal antecedent of the petitioner. Petitioner is in custody since 15.12.2017.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.9106 of 2018 (3) dt.26-03-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Chapra Rail Police Station Case No. 26 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
