JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Bijay Prakash Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26-05-2017 in G.B. Nagar P.S. Case No. 91 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 36, 30, 34, 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case. He submits that a pick-up van, which was standing near the house of petitioner, was intercepted by the police and from the said pick-up van, huge quantity of Indian make foreign liquor was recovered and since none of the accused person was apprehended by the police, being house owner, the petitioner
Patna High Court Cr.Misc. No.41711 of 2017(2) dt.15-09-2017 2/2 has been made accused in the present case. By way of referring to statement made in paragraph - 3 of the petition, learned counsel for the petitioner submits that petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Saroj Chaudhary @ Saroj Chudrhy be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Siwan in connection with G.B. Nagar P.S. Case No. 91 of 2017.
