The petitioner seeks bail in a case registered for the offence punishable under Sections 8/20 (b), (ii), (c), 1985 of the N.D.P.S. Act.

The allegation against the petitioner in collusion with other accused persons is said to have recovered 84 small packets contained narcotic material purported to be heroine, Rs.30,000/- and a loaded pistol from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As per FIR, allegation is that 95 grams heroine, an electronic weighting machine and currency notes were recovered from the possession of co-accused and from the

No.24292 of 2021(3) dt.01-11-2021 2/2 possession of the petitioner 84 small packets contained narcotic heroine, Rs.30,000/- and a loaded pistol were recovered and the present case relates to alleged N.D.P.S. Act. He further submits that the police has not weighted the said contraband articles, which were recovered from the conscious possession of the petitioner. The petitioner is languishing in judicial custody since 10.01.2021. The petitioner has got 02 criminal antecedents, which is mentioned in para 3 of the bail petition. Learned APP for the State vehemently opposed the prayer for bail application.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with N.D.P.S. Case No. 03/2021 arising out of Narayanpur P.S. Case No. 05/2021 to the satisfaction of learned Court below where the case is pending/ successor Court. (Anjani Kumar Sharan, J) amitkumar/- U T
