The petitioner is accused in connection with Saharsa Sadar P.S. Case No. 917 of 2018 registered under sections 341, 323, 504, 307, 34 of the I.P.C. and section 27 of the Arms Act pending in the Court of C.J.M., Saharsa. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to enmity and property dispute. Further submission is that petitioner is in custody since 04.10.2018. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is named in the first information report. Petitioner has

Patna High Court CR. MISC. No.15676 of 2020(3) dt.16-06-2020 2/2 criminal history. Further he submits that there is direct allegation of firing against the petitioner. Hence, this is not a fit case for bail.

Having considered the above facts and circumstances of the case and nature of allegation, this Court is not inclined to allow the prayer of the petitioner for bail. Accordingly, prayer for grant of regular bail of the petitioner is rejected.
