ANJANA MISHRA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is apprehending her arrest in connection with Kudara Case No.258 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code and Sections 3(2)V of the S.C./ST(POA) Act.
Learned counsel for the petitioner submits that the entire prosecution allegation against the petitioner is that the husband of the petitioner had taken away the father of the complainant/informant for giving work at Faizabad, but when he did not return, complainant's younger brother was sent to Faizabad but he could not find out the location of the father of
Patna High Court Cr.Misc. No.20232 of 2015 (3) dt.23-07-2015 2/2 the complainant/informant. It is only on account of the said fact that the informant became suspicious that the petitioner has some role to play in the disappearance of his father. Learned counsel for the petitioner submits that save and except the allegation made against the husband of the petitioner, this petitioner has no role to play whatsoever in the said act of disappearance of the father of the complainant/informant. Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the above named petitioner, in the event of her arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Kudara Case No.258 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
