The petitioner is in custody since 01.05.2017 in connection with a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code. Learned counsel for the petitioner submits that admittedly the informant had not seen who set her house on fire. As stated in the FIR, when she awoke up from her sleep due to fire, she could only see that her house was on fire. Thus, the statement of the informant that she saw four persons fleeing which also included the petitioner, appears to be quite unfounded. It is submitted that their names have been brought only on the basis of speculation as recently the house of one Shiv Naresh Singh had been set on fire on 03.04.2017.
