Mr. SMT PUSHPA SINHA ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Phenhara P. S. Case No. 15 of 2016 registered for the offences punishable under Sections 386, 387 and 307/34 of the Indian Penal Code and 27 of the Arms Act.

Informant is a Munshi of a construction company who in his written complaint has alleged that while he was engaged in construction work he received a call from Manoj Singh convener of Azad Hind Fauj Organisation for giving ransom of Rs.50 lacs, otherwise he would eliminate the Director of the company and also he would not allow him to work. On 23.2.2016 at about 2-45 P.M. two motorcycle borne miscreants came and asked the driver of JCB regarding whereabouts of informant on which driver told that he was not aware about his

Upon which the pillion rider fired upon the driver of JCB but the same did not hit the driver and thereafter they fled away. Name of petitioner has surfaced on the confessional statement of Manoj Singh and except that confessional statement there is no incriminating material against this petitioner. Petitioner is in custody since 10.3.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-XII, Motihari, East Champaran, in connection with Phenhara P. S. Case no. 15 of 2016.
