====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 21-06-2024 The instant petition has been filed seeking modification of the order dated 28.07.2023 passed by this Court in Cr. Misc. No. 38562 of 2023.

2. Learned counsel for the petitioner submits that it has been stipulated in the order dated 28.07.2023 that in case of surrender of the petitioner within a period of eight weeks from the date of passing of the order, he would be enlarged on bail subject to other conditions. Learned counsel further submits that during the relevant time, wife of the petitioner was pregnant and as the petitioner was the only person to look after his pregnant wife he could not surrender in terms of the order dated 28.07.2023. Learned counsel submits petitioner's unqualified apology to this Court for not complying the order and further

Patna High Court CR. MISC. No.25390 of 2024(2) dt.21-06-2024 2/2 submits his case may be considered with sympathy.

3. Having regard to the facts and circumstances, the order dated 28.07.2023 is modified and petitioner is directed to surrender within four weeks from today before the Court concerned.
