====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 30(a), 32, 41(1) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 711 litres country made liquor was recovered from seized Maruti Suzuki Car.

4. Learned counsel for the petitioners submits that no incriminating material has been recovered from conscious possession of the petitioners. Petitioners are neither drivers nor owners of the car in question and they have been made accused only on suspicion. Petitioners claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive Special, Excise Court No. 3, East Champaran, Motihari in connection with Kundwachainpur P. S. Case No. 15 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
