This application has been filed for modification of the order dated 01.02.2019 passed in Cr. Misc. No. 5740 of 2019, by which petitioner has been granted provisional bail with a condition that one of the bailors will be a close relative of the petitioner i.e. wife/brother/son.

Learned counsel for the petitioner submits that petitioner no.2, namely, Manindra Jay Bikram Shah @ Manindra Bikram Shah is unmarried person and two brothers have already been made accused in the present case and the third brother, who is not accused in the present case, is having no property at all.

In such view of the matter, close relative will be

Patna High Court CR. MISC. No.13600 of 2019(2) dt.06-03-2019 2/2 treated for the purpose of petitioner no.2 as uncle, maternal uncle, grand-father, maternal grand-father and son of his own uncle.

The time to surrender is further extended by three weeks.

Accordingly, the order dated 01.02.2019 is modified to the aforesaid extent only.
