Petitioner seeks regular bail in connection with Sonbarsa Raj P.S. Case No.12 of 2016 registered for the alleged offences under Section 394 of the Indian Penal Code. As per the prosecution case, two motorcycle borne criminals are said to have looted cash and chain of the informant on the point of pistol.

It has been submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. There is no specific allegation against the petitioner rather the same is general and omnibus in nature. Petitioner has no concern with the said occurrence. Petitioner is not named in the F.I.R. His name

Patna High Court Cr.Misc. No.32464 of 2017 (02) dt.13-07-2017 2/2 surfaced in the case on the basis of confessional statement of one co-accused Hemant. He has been languishing in jail custody since 19.02.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Sonbarsa Raj P.S. Case No.12 of 2016.
